Missouri Bank Fined Over RESPA Violations

A Missouri bank has been fined for allegedly violating the anti-kickback provisions of the Real Estate Procedures Act.

A consent order was issued against the bank that includes a $70,000 fine for allegedly violating the RESPA provisions.

RESPA prohibits mortgage lenders from paying real estate agents fees for the referral of settlement service business on home loans.

Pending Home Sales Beat Expectations

The number of pending signed contracts on existing homes jumped by the biggest amount in more than four years — blowing past expectations.

The seasonally adjusted Pending Home Sales Index reported on Monday jumped more than 6 percent between April and May.

The index tracks signed contracts on previously owned residential properties where the sale of the home has not yet closed.

U.S. Bank Reaches FHA Settlement

Just a month after revealing that it was under investigation, U.S. Bancorp has disclosed that it reached a large settlement over the handling of government-insured lending.

In May, the Minneapolis-based company said in a filing with the Securities and Exchange Commission that it was being investigated and examined by government agencies and bank regulators about its mortgage-related practices.

The Department of Housing and Urban Development Office of Inspector General and the Department of Justice were investigating its compliance with Federal Housing Administration insurance program requirements.

Lenders Load Up on Production Executives

Among all home loans serviced by banks and thrifts, government-sponsored enterprise loans are performing the best. Government-subsidized modifications are performing better than proprietary ones.

Banks and thrifts regulated by the Office of the Comptroller of the Currency serviced 24,503,971 first liens for $4.1297 trillion as of March 31. That represents around 48 percent of all U.S. first liens.

Prime mortgages, those with credit scores of at least 660, accounted for 75 percent of the portfolio. Alt-A loans, where scores were between 620 and 659, made up 10 percent, and subprime mortgage borrowers, who had scores of less than 620, represented 6 percent.
